A SUMMARY OF THE PROCEEDINGS OF THE MURRAY COUNTY BOARD

May 24, 2016 8:30 a.m. Pursuant to notice, the Murray County Board of Commissioners convened with the following members present: Commissioners Moline, Jens, Kluis, Magnus and Thiner. Also present Aurora Heard and Travis Smith.

MSP to approve the agenda as modified.

MSP to approve consent agenda items 1 and 2.

MSP to approve ditch contractor bills for County Ditch No.19 and Judicial Ditch No. 3 totaling $1,633.68

MSP County Ditch #6, Findings of Fact and Order Concerning Redetermination of Benefits, Pursuant to Minnesota Statutes 103E.351

MSP to approve two joint powers agreements with the State of Minnesota, acting through its Office of the Secretary of State allowing the Auditor-Treasurer to act as a Deputy Recount Official for automatic recounts for the 2016 State Primary Election (SWIFT Contract No 53492) and the 2016 State General Election (SWIFT Contract No 53492), further moving to authorize the Auditor-Treasurer and Board Chair to sign the agreement on behalf of the county.

MSP to approve ditch inspection report for County Ditches No.43, 46 and Judicial Ditch No. 67.

MSP to approve authorizing Coordinator Heard draft a letter to the City of Slayton terminating the lease agreement for office space with the City of Slayton effective December 31, 2016.

Chairman called the public hearing to order for licensing and sale of tobacco and related products and devices.

MSP to approve the revised tobacco ordinance, Ordinance #2016-05-24-01, repealing the previous tobacco ordinance #98-10-6-1.

Because the County of Murray recognizes that many persons under the age of 18 years purchase or otherwise obtain, possess, and use tobacco, tobacco related devices, electronic delivery devices, and nicotine or lobelia delivery products, and such sales, possession, and use are violations of both state and federal laws; and because studies, which the County hereby accepts and adopts, have shown that most smokers begin smoking before they have reached the age of 18 years and that those persons who reach the age of 18 years without having started smoking are significantly less likely to begin smoking; and because tobacco use has been shown to be the cause of several serious health problems which subsequently place a financial burden on all levels of government; this ordinance shall be intended to regulate the sale, possession, and use of tobacco, tobacco related devices, electronic delivery devices, and nicotine or lobelia delivery products for the purpose of enforcing and furthering existing laws, to protect minors against the serious effects associated with the illegal use of tobacco, tobacco related devices, electronic delivery devices, and nicotine or lobelia delivery products, and to further the official public policy of the State of Minnesota in regard to preventing young people from starting to smoke as stated in Minn. Stat. § 144.391.

MSP to approve a letter regarding the payment process for past ditch petitions.

MSP RESOLUTION NO. 2016-05-24-01, Resolution Approving State of Minnesota Joint Powers Agreements with the County of Murray on Behalf of its County Attorney and Sheriff.

MSP RESOLUTION 2016-05-24-02, Resolution Authorizing the Sheriff’s Office Assess to the MN Government Access System.

MSP Resolution No. 2016-05-24-03, Murray County Termination Buffalo Ridge Regional Transit Joint Powers Board Agreement

MSP RESOLUTION NO. 2016-05-24-04, Resolution Approving Joint Powers Agreement

MSP to approve the effective date of the Clean Indoor Air Ordinance, Ordinance #2016-05-17-01, is ninety (90) days after publication in the official paper.

MSP to approve hiring Suzanne Pagel as a Museum Assistant.

MSP to approve Coordinator Heard set up an account with First Lab.

Open Forum/Public Comment – No members of the public were present. MSP to approve the Commissioner Vouchers for the period of May 8, 2016 to May 21, 2016.

MSP to accept the 2016-2017 Radio Marketing Proposal of $199.48 per month for advertising on KJOE 106.1 and KISD 98.7 from May 24, 2016 to May 23, 2017, further moving to authorize the Board Chair to sign the agreement on behalf of the county.
